Q: How is the property distributed among residuaries?

Ans:  There are five primary heirs i.e. Father, mother, wife,  son and daughter. The property will be distributed in residuaries in following way:

1.  The son is included in residuaries and will take all residue if daughter is not present.

2.  If son is not present,  son's son will be the residuary and will take the whole residue after distributing the share to quaranic heirs.

3.If son's son is not present,  son's son's son will be the residuary and will take the whole residue after distributing the share to quaranic heirs.

Then son's son's son's son and so on.

4. If children are not present, father will take the entire residue.

5. In absence of father, true grandfather will take the entire residue.

6. If no ancendent and descendent, the male collateral i.e full brother will take the entire residue if female collateral i.e full sister is not present.

7. If full brother and full sister are not present, the consanguine brother and consanguine sister will be seen.

If full brother, full sister and consanguine sister are not present, the consanguine brother will take the entire residue.

8. If no above residuaries are present,  the full brother' s son will take the entire residue.

9. If no above 8 residuaries are present,  the consanguine brother's son will take the entire residue.

10. If no above 9 residuaries are present,  full brother's son's son will take the entire residue.

11. If no above 10 residuaries are present,  the consanguine brother's son's son will take the entire residue.

Now descendents of true grandfather:

12. If no above 11 residuaries are present,  the full paternal uncle will get the entire residue.

13. If no above 12 residuaries are present,  the consanguine paternal uncle will get the entire residue.

14. If no above 13 residuaries are present,  the full paternal uncle's son will get the entire residue.

15. If no above 14 residuaries are present,  the consanguine paternal uncle's son will get the entire residue.

16. If no above 15 residuaries are present,  the full paternal uncle's son's son will get the entire residue.

17. If no above 16 residuaries are present,  the consanguine paternal uncle's son's son will get the entire residue.

Likewise the process goes on.
